What is each document?
Freedom from Liens: It is issued by the Public Registry of Real Estate of the department where it corresponds according to the location of the property, where the registration of the real estate subject to negotiation is verified. It verifies and certifies the holder/owner of the property and that the property has no encumbrances or annotations that restrict its free disposition and transfer, no restrictions and can (the owner) freely dispose of it.
Municipal Solvency: Verify the solvency of the payment of the real estate tax (IBI) to which the property is subject. There are no obligations to the municipality to date. This payment is annual.
Cadastral Certificate is a legal technical document. It is used to process the registration of the modification of the right or transfer of ownership of real estate in order to update and unify the information in the cadastral and registry database. It is issued by the General Directorate of Physical Cadastre or by its delegate offices in the departments. There are requirements to manage and obtain this document related to the ownership of the property in question.
Constancia de Datos Catastrales is an informative document. It allows to know the cadastral number, the location, the owner (of the selling or transferring party), the area and the registry data of the property.
The topographic plan is reviewed and approved by the General Directorate of Physical Cadastre, which approves it for cadastral purposes. To this end, they must be prepared by authorized surveyors, with a Cadastral License and its code. They must comply with the specifications and technical provisions established by the General Directorate of Physical Cadastre.
We recommend you to always ask the seller for the plan approved by cadastre for the signature of the deed of acquisition of a property, in order to avoid setbacks and risks.
